The Office of the General Counsel provides legal services throughout the Department of Homeland Security in all areas of homeland security, including transportation security. The Chief Counsel for TSA provides and oversees legal advice and services for TSA.

If you are selected for this position, you will serve as the Attorney for Field Operations in the Office of Chief Counsel. You will report to the Chief Counsel and be under the supervision of the Deputy Chief Counsel for Field Operations and the Supervisory Attorney-Advisor for the Las Vegas International Airport. You will be advising TSA management, including TSA’s Office of Security Operations and Office of Law Enforcement/Federal Air Marshal Service on transportation security issues. You will be working proactively with local senior agency leaders, industry partners and stakeholders, and other Federal, state, and local government officials concerning immediate and long-term Homeland Security initiatives, operations, programs, and policies. As legal advisor for agency operations at airports, and transportation modes across a large geographic region, with thousands of employees, and some portion of over 2 million passengers daily, you will be providing critical legal and policy advice for developing, coordinating, and communicating organizational policies, procedures and guidelines in relation to transportation security. In addition to transportation security law matters, you will be performing legal work on various complex legal issues facing the agency with an impact on transportation security, including Constitutional Law (search and seizure, law enforcement support); General Law (employment and civil rights, ethics, labor relations); Enforcement (civil and criminal enforcement, Federal Air Marshals, stakeholder compliance); and Operational Law (incident management and response).

Duties and responsibilities include:

  • Responsible for extremely complex and difficult legal questions or factual issues involved in drafting, interpreting, or applying opinions, Constitutional provisions, statutes, legislation, regulations, decisions, reports, responses, protocols, and other legal instruments that may require original legal endeavor and critical thinking to balance conflicting interests.
  • Working closely with local, state, and national authorities on cases related to TSA to ensure that attorney in those offices are informed of TSA policies, relevant case law, and the need to protect Sensitive Security Information.
  • Providing written and oral counsel, legal reviews, opinions, security standards, regulations, or decisions in the application of the U.S. Constitution, Federal laws, legislation, or policies to programs conducted or assisted by DHS components, and to DHS policies.
  • Developing, or overseeing the development of legal positions, legislative proposals, regulatory documents, policies, and operations that involve significantly broadening or restricting agency activities and affecting the agency\'s security posture and the public interest. This includes giving legal guidance on issues garnering high levels of media visibility.
  • Developing legally sound approaches regarding sensitive matters, such as national security issues, privacy, and civil rights and liberties of the traveling public, and delicate personnel and other matters involving senior executive officials.
  • Representing TSA in conferences and meetings with representatives of other Executive Departments and agencies, Congress, and Legislative Branch agencies, State and Tribal governments, local governmental and quasi-governmental organizations, private industry, labor organizations, foreign government representatives, domestic and international stakeholder groups, and the U.S. public in regard to legal matters of interest.


The major duties described above reflect the full performance level of this position. Typically, the lower Pay Band (I band) performs the same duties but will receive more guidance and training; and/or projects/work assignments may be less complex.

To qualify for the SV-I Pay Band (equivalent to GS-13), you must have one year of specialized experience equivalent to the SV-H Pay Band or GS-12 in the Federal service or equivalent experience in the private sector. Specialized experience is defined as experience that has equipped you with the knowledge, skills, and abilities to successfully perform the duties of the position. Such experience includes progressively responsible legal experience of sufficient scope, complexity, and quality to be able to carry out effectively the duties of the position. Specific experience for this position includes applying knowledge of U.S. Constitution, Federal laws, statutes, policies, and case decisions; and providing legal counsel and policy guidance to clients.

To qualify for the SV-J Pay Band (equivalent to GS-14), you must have one year of specialized experience equivalent to the SV-I Pay Band or GS-13 in the Federal service or equivalent experience in the private sector. Specialized experience is defined as experience that has equipped you with the knowledge, skills, and abilities to successfully perform the duties of the position. Such experience includes progressively responsible legal experience of sufficient scope, complexity, and quality to be able to carry out effectively the duties of the position. Specific experience for this position includes addressing diverse and complex legal issues; and providing comprehensive legal counsel and policy guidance to clients who manage programs related to intelligence, national security, or threats to transportation infrastructure and the traveling public.

To qualify for the SV-K Pay Band (equivalent to GS-15), you must have one year of specialized experience equivalent to the SV-J Pay Band or GS-14 in the Federal service or equivalent experience in the private sector. Specialized experience is defined as experience that has equipped you with the knowledge, skills and abilities to successfully form the duties of the position. Specific experience for this position includes overseeing legal work that has cross organizational impact; and providing expert legal counsel and policy guidance to clients who manage programs related to intelligence, national security, or threats to transportation infrastructure and the traveling public.

All applicants MUST (1) hold a first-level law degree (e.g., J.D. or L.L.B.) from a law school accredited by the American Bar Association; and (2) be an active member in good standing of the bar of a state, the District of Columbia, the Commonwealth of Puerto Rico, or a territory of the United States. Volunteer work helps build critical competencies, knowledge, and skills and can provide valuable training and experience that translates directly to paid employment. You will receive credit for all qualifying experience, including volunteer experience.

NOTE: Credit for experience is given based on a 40-hour workweek. Part-time experience is credited on a part-time ratio, i.e., working 20 hours per week for two months equals one month of experience. No additional credit is given for overtime.
